Terms of service

Last updated: September 8, 2026

1. Overview

This website and online store are operated by Ashleigh Neal under the business name MuscleWrap ("MuscleWrap," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of our website, store, content, products, and related services (collectively, the "Services"). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

By accessing the Services, creating an account, or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

These Terms do not limit any non-waivable rights or remedies available to you under applicable consumer-protection law.

2. Eligibility

You may use the Services only if you are legally capable of entering into a binding agreement where you live. If you have not reached the age of majority in your province, territory, state, or country, you may use the Services and make purchases only with the involvement and permission of a parent or legal guardian.

You may not use the Services or our products for any unlawful or unauthorized purpose.

3. Product Information and Intended Use

We make reasonable efforts to describe and display our products accurately. However, colours and appearance may vary depending on lighting, photography, manufacturing batches, and your device display. Measurements and sizing information are approximate unless stated otherwise.

MuscleWrap products are general fitness accessories. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition. Product descriptions and other content on the Services are provided for general information and are not medical or professional advice.

Read and follow all product instructions, warnings, sizing information, and care directions. Use each product only for its intended purpose. Stop using a product if it is damaged, fits improperly, restricts circulation, or causes pain, numbness, unusual discomfort, or another concerning reaction. If you have an injury, medical condition, circulation concern, or uncertainty about whether a product is suitable for you, seek advice from a qualified healthcare professional before use.

We may modify or discontinue products and may limit quantities, subject to orders we have already accepted and applicable law.

4. Prices, Currency, Taxes, and Duties

Prices are shown in the currency displayed at checkout and may change without notice. A price change will not affect an order we have already accepted, except where correction is permitted by law and these Terms.

Applicable taxes, shipping charges, and other charges will be displayed before you complete your purchase where reasonably determinable. For international orders, you may be responsible for customs duties, import taxes, brokerage fees, or other government or carrier charges unless checkout expressly states that they are included. These charges are not controlled by MuscleWrap.

Discount codes and promotions are subject to their stated conditions, availability, and expiry dates. Unless stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or used after expiry.

5. Orders and Contract Formation

Before submitting an order, you will have an opportunity to review your cart and checkout information and correct errors. You agree to provide current, complete, and accurate billing, contact, and shipping information.

Submitting an order is an offer to purchase. An automated order-confirmation email acknowledges that we received your order but does not necessarily mean we have accepted it. We accept your order when we begin fulfilment, send a shipping confirmation, or otherwise expressly confirm acceptance.

We may decline or cancel an order before acceptance for legitimate reasons, including:

  • a product being unavailable;

  • an obvious pricing or product-information error;

  • inability to verify payment or delivery information;

  • suspected fraud, unauthorized activity, resale, or abuse;

  • a shipping restriction; or

  • a legal or safety concern.

If we cancel an order after payment has been authorized or collected, we will reverse the authorization or refund the affected amount to the original payment method. Nothing in this section permits us to cancel an accepted order contrary to applicable law.

We may limit quantities purchased per person, household, account, payment method, or order where reasonably necessary to prevent fraud, resale, or inventory abuse.

6. Payment

Payments are processed by Shopify and our payment providers. You authorize the applicable payment provider to charge the total shown at checkout to your selected payment method.

You represent that you are authorized to use the payment method and that the information you submit is accurate. We do not generally receive or store complete payment-card numbers. Payment processing may be governed by additional terms and privacy policies from Shopify, your financial institution, or another payment provider.

7. Shipping, Delivery, and International Fulfilment

Orders may be sourced, fulfilled, and shipped by third-party suppliers, fulfilment partners, and carriers, including HyperSKU. Products may ship from facilities outside Canada, including in the United States, China, or other countries. Different items in the same order may arrive separately.

Processing and delivery times are estimates unless we expressly guarantee a date. Delays may occur because of customs processing, carrier disruption, weather, incorrect address information, high order volume, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you discover an error. We will try to help, but we cannot guarantee a change after fulfilment begins.

Shipping, delivery, lost-package, refused-delivery, and address-error matters are further described in our Shipping Policy and Return and Refund Policy. Nothing in these Terms limits cancellation or refund rights that apply when an order is not delivered within the time required by law.

8. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, exchanges, replacements, and order-cancellation requests are governed by our Return and Refund Policy, which forms part of these Terms.

Do not send products to our Vaughan mailing address, HyperSKU, a manufacturer, a supplier, or the address on the original parcel unless we specifically authorize that destination. Contact support@musclewrap.ca for return instructions.

Our policies are in addition to rights and remedies available under applicable consumer-protection law.

9. Accounts and Account Security

If customer accounts are available, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Notify us promptly if you believe your account has been accessed without authorization.

We may suspend or restrict an account where reasonably necessary to protect the customer, other users, our business, or the security and integrity of the Services. We will not be liable for loss caused by your failure to protect your credentials, except to the extent that the loss was also caused by our failure to use safeguards required by law.

10. Acceptable Use

You must not:

  • use the Services for unlawful, fraudulent, abusive, or deceptive activity;

  • interfere with the security, operation, or availability of the Services;

  • introduce malware, harmful code, or automated traffic that places an unreasonable load on the Services;

  • attempt to gain unauthorized access to an account, system, or data;

  • scrape, copy, or extract substantial portions of the Services except as permitted by law;

  • impersonate another person or misrepresent your identity or authority;

  • submit false reviews, fraudulent claims, or inaccurate payment or delivery information; or

  • use our intellectual property without permission except as allowed by law.

We may investigate suspected violations and restrict access where reasonably necessary. We may also cooperate with lawful requests from authorities.

11. Intellectual Property

The Services—including our branding, logos, graphics, photographs, product descriptions, site design, and original content—are owned by or licensed to MuscleWrap and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial shopping purposes. This licence does not permit you to reproduce, distribute, modify, sell, sublicense, or commercially exploit our content without written permission, except as permitted by law.

Third-party names, marks, and content remain the property of their respective owners.

12. Reviews, Feedback, and Other Submissions

If you submit a review, photograph, comment, suggestion, or other content ("User Content"), you retain ownership of your content. You give MuscleWrap a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, format, and use that User Content for operating, improving, and promoting the Services, subject to our Privacy Policy and applicable law. This licence ends when the User Content is deleted from our Services, except where copies must reasonably be retained for legal, security, backup, or recordkeeping purposes, or where the content has already been used in materials that cannot reasonably be withdrawn.

You represent that you have the right to submit the User Content and that it is honest and does not infringe another person's rights. Do not submit unlawful, threatening, defamatory, deceptive, infringing, malicious, or privacy-invasive content.

We may moderate or remove User Content that violates these Terms, but we are not obligated to monitor every submission. We will not materially alter a customer review in a way that misrepresents the customer's opinion.

13. Third-Party Services and Links

The Services may contain tools, payment methods, links, or integrations provided by Shopify or other third parties. We do not control independent third-party websites or services and are not responsible for their content, availability, security, or privacy practices.

Your use of a third-party service may be governed by that provider's own terms and privacy policy. Review those terms before using the service. This section does not limit responsibility that applicable law places on us for service providers acting on our behalf.

14. Privacy

Our collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy. Shopify and other providers may also process information under their own privacy notices, as explained in that policy.

15. Service Availability and Errors

We try to keep the Services accurate, secure, and available, but we do not guarantee uninterrupted or error-free access. We may correct typographical errors, inaccuracies, or omissions and may temporarily restrict access for maintenance, security, updates, or events outside our reasonable control.

If an error affects an order, we will address it fairly and in accordance with applicable law. We will not rely on this section to change a material term of an accepted order without your agreement where the law requires that agreement.

16. Warranties and Disclaimers

Except for warranties, conditions, representations, and remedies that cannot legally be excluded, the Services and website content are provided on an "as available" basis. We do not promise that every website feature will always be uninterrupted, secure, or error-free.

We do not exclude or limit any statutory warranty or condition concerning product quality, fitness, safety, description, title, or other matter where exclusion is prohibited by law. Product-specific warranties, if any, will be stated on the applicable product page or included with the product.

17. Limitation of Liability

To the fullest extent permitted by law, MuscleWrap will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when you entered into the agreement.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, or personal injury caused by negligence where applicable law prohibits that limitation. Nothing in these Terms limits your mandatory consumer rights or remedies.

Where liability may legally be limited, our total liability arising from a particular order will not exceed the amount you paid for that order. This monetary limit does not apply where applicable law prohibits it.

18. Indemnification

To the extent permitted by law, you agree to compensate MuscleWrap for reasonable losses, liabilities, and costs arising directly from your unlawful misuse of the Services, your intentional violation of these Terms, or User Content that you submit without the necessary rights. This section does not require you to compensate us for our own negligence, breach of contract, or violation of law.

19. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access where you materially violate these Terms, engage in fraud or unlawful activity, or create a genuine security or safety risk.

Termination does not affect rights and obligations arising before termination, including payment obligations, accepted orders, returns, refunds, intellectual-property rights, and provisions that by their nature should continue.

20. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.

Any dispute may be brought before a court or tribunal with jurisdiction under applicable law. If you are a consumer living outside Ontario, you may also have mandatory rights and access to courts or regulators in your home jurisdiction. Nothing in these Terms requires you to give up those rights.

21. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, or legal requirements. The revised Terms will be posted on the Services with an updated "Last updated" date, and any additional notice required by law will be provided.

Changes apply prospectively from their effective date. The Terms in effect when an order was accepted will generally govern that order unless a change is required by law or you agree otherwise.

22. General Provisions

If a provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion is not a waiver of that provision or our right to enforce it later.

These Terms, together with the policies and information incorporated by reference and the order details presented at checkout, form the agreement between you and MuscleWrap concerning the Services and your purchase.
